DEFINITIONS

The “Seller” is defined as the legal entity Forever Cake Creations.

The “Buyer” means the person (legal or natural) who buys the goods.

Goods” is defined as the items to be supplied by the Seller to the Buyer as listed in this invoice.

Conditions” is defined as the Terms and Conditions as outlined by Forever Cake Creations.


GENERAL

The Terms and conditions will apply to the sale of the Goods by the Seller to the Buyer and will exclude all other terms and conditions referred except where the Seller has agreed to any variation in writing and signed by the Buyer. By ordering from Forever Cake Creations you agree to be legally bound by the Conditions.


PAYMENT AND DEPOSIT

At the time of the Buyer placing the order the Seller requires a 50% non-refundable deposit to confirm the order and to hold the date of the event. The remaining 50% is due 4 weeks prior to the date of delivery, at which time any changes must be confirmed in writing (changes to the previously agreed design and ingredients may attract extra costs). Any orders placed less than 4 weeks in advance of the delivery date must be paid in full. The final balance specified on the invoice must be paid by the Buyer 4 weeks prior to the date of delivery. If payment is not received 4 weeks prior to the delivery date then this may result in the order being cancelled. By making any payment the Buyer accepts the Conditions as outlined.


REFUNDS AND CANCELLATIONS

Deposits are non-refundable due to any loss of business arising from turning away other bookings on the event date. Full payments made less than 4 weeks in advance of the date of the event are non-refundable. Full payments made more than 4 weeks in advance of the delivery date will attract a cancellation fee. The Seller cannot refund the cost of any orders cancelled with less than 4 weeks notice. Orders paid in full and cancelled with more than 4 weeks notice will receive a partial refund of 50% of the total order value. In the unlikely event that the Seller has to cancel your order for any reason, the Seller will give the Buyer as much notice as possible, the Seller will offer a suitable alternative. If the Buyer does not wish to accept the Seller’s suggested alternative, the Buyer will be entitled to a full refund.


CONSULTATIONS

All consultations are by appointment only, appointments for a consultation and tasting must be agreed with the Seller in writing and can be subject to a non refundable fee of £30.00 which must be paid prior to the consultation date before it can be confirmed. This date will then be confirmed in writing by the Seller. Should the Buyer choose to accept the Seller’s quote this will be deducted from the final cost of the cake.


PRICE QUOTATIONS

All price quotations, written or verbal, will be valid for 30 days from the date of quotation.


ALTERATIONS

If the Buyer needs to make any changes following the consultation and agreed quote they must contact the Seller immediately, any changes must be submitted in writing. On receipt of the request the Seller will endeavour to accommodate the change request for any alterations, this will be dependent on the type of changes the notice the Seller is given. The Seller will then advise the Buyer if there will be any effect on the price and any agreed timetable. Any alterations are at the discretion of the Seller and any alterations requested less than 4 weeks before the event date may be subject to a surcharge.

We reserve the right to change the design at any point if circumstances beyond our control, may compromise the quality of the finished cake, e.g. Melting due to weather.


CAKE STAND HIRE

The Seller can provide cake stand hire for which there will be a hire fee of £20.00 plus a security deposit of £100 required in advance. The Seller has a variety of stands and will provide one most suited to the style of the Buyer’s cake. It is the Buyer’s responsibility to return the cake stand/s after hire to the Seller’s premises within 7 working days. Collection by the Seller can be arranged for a fee of £20.00, which must be agreed in writing. The deposit will not be refunded in the event that the stand/s is/are damaged, or not returned within the 7 day, period (unless previously agreed in writing). If returned within the given timeframe and the Seller is satisfied that there is no damaged the Seller will refund the deposit to the Buyer.


SPECIAL DIETARY REQUIREMENTS

The Buyer must discuss any allergies or special dietary requirements with the Seller prior to making payment.


DELIVERY AND COLLECTION

The Seller cannot be held liable for any damages to the cake or products once they have been delivered, or delivered and set up at the venue and have evidence for the safe delivery of the Goods. If the cake or products are collected from the Seller, then the Seller cannot be held liable for any damages to the cake or products once they have left the Sellers premises. There will no delivery or set up charge if the venue is within a 15 mile radius of the Seller’s premises, however, distances over that will attract a further cost. It is the responsibility of buyer to ensure the temperature at the venue does not impact the cake once it has been delivered and set up


NON-EDIBLE INGREDIENTS AND DECORATIONS

The Seller's Goods may contain non-edible ingredients or decorations, such as plastic dowels in tiered cakes or wires in some sugar flowers. These will be listed on the Delivery Note and must be discarded before serving or eating. The Seller may use dummy tiers, particularly with Gluten, Dairy or Vegan cakes and replaced with cutting cakes. Dummy tiers are also used to add height to the wedding cake or if weather affects stability of the chosen flavours.


COMPLAINTS

If the Buyer wishes to make a complaint to the Seller or to advise the Seller of any concerns after receiving the Goods, please do so in writing, with any photographic evidence. Any refunds will be given entirely at the Seller’s discretion.
